公众参与民族民间文化遗产保护的法理基础及制度安排

由于民族民间文化遗产在整体权益上具有公权性质,因而,政府在保护文化遗产方面肩负着最主要的责任,发挥着主导作用.然而,要保护好民族民间文化遗产,仅依靠政府之力并不足以达到最好的效果,因此,政府以外的其他群体、组织乃至个人的理解、合作、支持、配合、参与、协助、援助、督促等都是必要的.联合国教科文组织<保护非物质文化遗产公约>明确地将公众参与确立为其基本原则之一.本文从公众参与保护民族民间文化遗产的法理基础入手,探讨了该原则在民族民间文化遗产保护立法环节、行政执法环节、监督和救济环节中的制度安排.
