| 摘 要： | 随着知识经济时代的来临,由技术和经营信息构成的商业秘密在社会生活中所处的地位越来越重要,侵犯商业秘密的现象也越来越多.社会经济的发展要求法律对商业秘密进行全面的保护,而准确把握商业秘密的构成要件是维护商业秘密持有者合法权益的前提条件.因此,对商业秘密各构成条件的研究是理论界的当务之急.
