经济法动态性初探

经济法作为国家干预经济之法,必须随着社会经济形势和市场的变化而变化,此即经济法的动态性.经济法的动态性不同于不确定性、模糊性.经济法的动态性具有变动性、扩张性与回复性、相对稳定性的特点.经济法的动态性与民商法、行政法的动态性特性又有明显的区别.之所以有区别,既有经济法自身品格方面的原因,又与市场失灵、政府失灵等外部条件有关.以动态眼光来看经济立法的意义在于不应一味追求经济法典的制定,而应致力于建立原则性与灵活性相结合的经济法律体系;经济法理论研究的意义在于经济法理论研究必须立足于本国国情,积极创建有中国特色的经济法理论.

The Dynamic Nature of Economic Laws

Economic laws through which government interferes with the country's economy must change in accordance with the changes in the social economic situations. Economic laws have therefore a dynamic nature. It points to neither instability nor ambiguity. It is characterized by flexibility, expansion and reversibility.The dynamic nature of economic laws is different from that of civil commercial laws and administrative laws in property. The difference is caused not only by the characteristics imbedded in the economic laws, but also by the malfunctions in the market and the government. Looking into the effects of economic laws, it is not advisable to make economic codes. Instead, an economic law system with principles and flexibility combined is the aim. The significance of studying the theories of economic laws lies in basing the research on this country's situations in order to develop economic law theories with Chinese characteristics.
