| 摘 要： | 以民商法和运输法律的基本理论为依据 ,以现行世界上货物多式联运的主要法律制度的比较分析为基础 ,借鉴法律经济学的相关理论和观点 ,评析现行国际货物多式联运经营人责任制度 ,提出确定国际货物多式联运经营人责任制度应遵循的原则 ,应采用的国际货物多式联运经营人责任的归责原则和责任限额 ,以及完善我国货物多式联运经营人责任制度的建议。 |

| Abstract: | In the light of basic theories of civil and transport law, based upon the comparative analysis on the main legal systems of multimodal transport prevailing in the world, and by reference to the related concepts of economics and law, comments are given on the main prevailing liability systems of multimodal transport operator (MTO). Detailed opinions are given on the principles to be followed in determining MTO's liability system, the basis of liability and limit of liability thereof, followed by the suggestions on the improvement of MTO's liability system in China. |
