| 摘 要： | 在权法之争问题上，中国人存在二元的思维模式。中国法律传统中“政道”理论的缺失和宗法伦理的过度渗透都影响了这种思维模式的形成；目前，我们对权力问题的学理研究与法律设计也存在一定的缺陷。

| Abstract: | There exists a dualistic mode of thinking among Chinese over the issue concerning the struggle between power and law.In the legal tradition of China,both the lack of political art and the over infiltration of patriarchal moral principles influenced the formation of this mode of thinking;currently,there must be some shortcomings in our theoretical study and legal design with regard to the issue of power. |
