我国土地所有权主体重构问题探索

土地所有权主体虚置是我国当前土地问题深层次的原因。该文在维护土地的社会主义公有制，考虑现有土地利益主体的现实利益基础上，针对国有土地所有权主体虚置问题，提出应依照现有的国有土地隶属和审批关系确定各级政府土地所有权，由县级政府根据行政管辖属地范围核发统一的土地所有权和使用权证书，由各级政府根据土地用途分类管理。文章认为现在被称为农民集体所有的农村土地的所有权主体不仅是虚置的，而且所有权是残缺的，事实上国家拥有农村土地的所有权，村民委员会和村民小组不应也不能成为农村土地所有权主体，各级政府应成为农村土地的所有权主体。其中农用地划归中央政府，其他划归县级政府，这实际上是一个公有化改造过程。
