| 摘 要： | 1997年修改的刑法第20条第3款专门规定了针对一定范围内的暴力犯罪的无限防卫权,为此,刑法学界进行了激烈的争论。本文就行使无限防卫权是否存在必要的限度这个问题作以探讨,指出正确认定和把握无限防卫权的必要限度,更有利于实现我国刑法“惩罚犯罪,保护人民”的任务
