中英古建筑保护制度比较研究

文物保护单位制度是一项具有中国特色的文物保护制度,从产生至今,在不可移动文物的保护中发挥了较大作用。阐述该制度产生发展的历史,对其中最重要的三项制度,即认定制度、“四有”制度及经营管理修缮制度进行规范法律分析,指出我国文物保护单位制度中存在的不足,并对英国的登录建筑与保护区制度进行学习和借鉴,以期对我国文物保护单位制度的进步有所裨益。

Comparative study on protection institution of ancient buildings in China and UK

The institution of cultural relic protection unit is an institution of cultural relic protection with lots of Chinese characteristics, which exerts greater function in the protection of immovable cultural relics since its generation. The history of its emergence and development is expounded. Normal analysis of law is produced on three most important institutions among it, namely, the recognition institution, the “four haves” institution and the management and repair institution. The deficiency of institution of cultural relic protection unit in China is pointed out. The institutions of login architecture and protection zone in UK are studied and used for reference, in order to benefit the improvement of institution of cultural relic protection unit in China.
