文化遗产保护立法的特点与功能

随着我国《非物质文化遗产法》的颁布实施,文化遗产保护立法工作逐步开展,制定统一的《文化遗产法》成为建设文化遗产保护法律体系的重中之重。由于文化遗产保护本身的特殊性,文化遗产保护立法与其他部门法相比更注重程序规则和实体规则的融合,重视专业知识在法律中的适用,而这些特点最终决定了文化遗产保护立法所具有的评价、管理、协调等特殊功能。研究文化遗产保护立法的特点和功能,能够从立法学理论角度为统一的《文化遗产法》的制定打下基础。

Along with the promulgation of “Intangible Cultural Heritage Act”, the implementation of legislation to protect cultural heritage has gradually developed, in which the establishment of unified“Cultural Heritage Law” has top priority in building the legal system of cultural heritage protection. Due to the special characteristics of cultural heritage protection, the integration of procedural rule and substantive rule is paid more attetion, and the application of expertise is emphasized in cultural heritage protection legislation compared with other departments of law. These characteristics ultimately determine the special functions of evaluation, management and coordination etc. of cultural heritage protection legislation. To study the characteristics and functions of cultural heritage protection legislation can provide basis for the constitution of unified “Cultural Heritage Law”from perspective of legislation theory.
