| 摘 要： | 包拯在从政过程中重视以法治国,维护法律的尊严,提出法存画一、赏德罚罪、防微杜渐、严惩赃吏等一系列针对时弊的法治思想。传世的包拯亲自处理的民刑案件并不多,但从中可见包拯司法实践中智慧、刚正、廉洁断案的特色。后来流传的包拯上百个断案故事,掺杂许多虚构、夸张或迷信的成分,不过在一定程度上也反映了这方面的特色。

| Abstract: | In his course of entering politics,BAO Zheng attaches great importance to legal management of state affairs and the maintenance of legal dignity.He comes up with a series of legal thoughts which includes the combination of law and sense,the rules for reward and punishment,the idea about a stitch in time saving nine and the rules of punishing the corrupt official strictly,etc.With the few civil and criminal cases handled personally by BAO Zheng,we can find out the characteristic of his wisdom,integrity and honest justice during his judicial practice of these cases.Later on,although there are many popular stories about BAO Zheng＇s judicial practice mixing up with a lot of fictional,exaggerated and superstitious elements,these partly reflect the characteristics of his justice and wisdom. |
