| 摘 要： | 在当代中国，司法所纠纷解决曾一度呈现鼎盛繁荣之势，但仅为昙花一现，旋即开始退化并逐步走向低迷。司法所纠纷解决功能缘何在当代中国的转型时期开始呈现颓废之势？其在当代中国还有无存在的必要性？在未来中国，司法所纠纷解决功能还能否雄风再现？能否在对其重新定位基础上继续发挥固有优势并在转型时期中国纠纷解决机制中占据一席之地？这些都是司法所纠纷解决在转型时期的当代中国所必须直面的问题。

| Abstract: | In contemporary China, judicial department＇s dispute resolution had once been at high tide, but only was a flash in the pan. Soon the function of judicial department＇s dispute resolution degenerated and gradually began to decadence. Why the function of judicial department＇s dispute resolution becomes to show the depravation in contemporary China＇s transferred period？ Does it have the need to exist in contemporary China？ Can the function of judicial department＇s dispute resolution renerve in the future？ Or can it continue to exert its advantage on the basis of its repositioning and further to take up a place in the transferring China＇s dispute settlement mechanism？ These are the problems which the judicial department＇s dispute resolution in contemporary China＇s transition period must face up. |
