| 摘 要： | 清末法制变革使我国契约法制面貌发生了很大的改观 ,主要体现于民律草案之中 ;北洋政府时期所完成的第二次民律草案 ,从其内容上看 ,有关契约法的规定更为科学 ;南京国民政府时期的民法典中对契约的规定较之前两部草案则有较大变动 ,主要体现在体例的变化以及注重社会公益等方面。考察近代中国契约法制的发展轨迹 ,对于当代中国的法制建设 ,具有重要的借鉴意义

| Abstract: | Reformation of legal system at the end of Qing Dynasty causes great change in contract law system, especially in civil law. Contract law becomes more complete under the reign of Beiyang Government and this leads to further development by the government of KMT. The paper surveys the history of development for contract law in China. |
