| 摘 要： | 德国的违宪审查制度是通过宪法法院这一专门审查机构来完成，而中国的违宪审查则属于立法机关的职能。中德两国违宪审查制度在审查主体、审查对象与方式、审查程序以及审查后果方面存在差异，我国违宪审查制度符合国情需要，但德国违宪审查制度中相对独立的审查体制与启动程序的制度设计，也值得我们借鉴吸收。

| Abstract: | Unconstitutional Review in Germany is completed by the specialized agency of Constitutional Court,while,in China,unconstitutional review is one of the functions of the legislature.Consequently there are differences between the review subject,review object and method,review process and review consequences.Unconstitutional review system of China meets its realistic conditions,but the independent judicial review system and the system design of the start process in the German system is worthy to be learned from... |
