商业贿赂犯罪独立设罪研究

商业贿赂的泛滥是中国社会转型时期重要的经济和社会现象之一,对中国经济和社会的发展构成巨大威胁。现行刑法关于贿赂犯罪的规定涉及公务贿赂和业务贿赂两个规范体系,立法为两罪所配置的构成要件无法全面反映对商业贿赂犯罪实施刑法规制的客观要求。基于此,有必要完善我国刑法,将商业贿赂设计为并列于前两类贿赂犯罪的独立形式,以此形成我国完备的贿赂犯罪惩治体系。

On the Independence of Commercial Bribery Crime

The prevailing of commercial bribery crimes, which made magnitude threaten to our economic and socialdevelopment, is one of the important economic and social phenomena in our social transforming period in China. Thebribery crimes are divided into two criterion systems by current China criminal law, such as public official bribery crimesand operation bribery crimes. Two systems are configured with different constitution elements. However, this method oflegislating cannot adapt to the impersonality demand of controlling the commercial bribery crimes. In order to establishingself-contained bribery crimes punishing system in China, it is indispensable to perfect our criminal law by designing thecommercial bribery as an independence crime system which stand above two bribery crimes.
