| 摘 要： | 土地所有制是理解蒙古族封建社会的钥匙,学术界有私有制论和公有制论两种截然不同的观点.用西方法学概念去解释蒙古族的传统法律必然会得出错误的结论,因此,必须从蒙古族社会游牧经济的特点出发,才可以对蒙古族的土地所有制做出科学的判断.

| Abstract: | Understanding of land ownership is the key to the understanding of Mongolian feudal society,among the academia,there are two different opinions:private ownership and public ownership.It is bound to lead us to wrong conclusions by explaining Mongolia's traditional law in Western legal concepts.Therefore,the author is of the viewthat it is only starting from the special characteristics of the Mongolian nomadic society that we can make a scientific judgment about the land ownership of the Mongolian. |
