| 摘 要： | 在GHM理论对权利集合“二分法”的基础上,透过探讨权利的本质,认为权利来源于信息,并且确立了权利生效的条件,即权利的行动范围和行动能力相互匹配,将整个权利集合划分为契约权利、信息权利和公共领域三部分即“三分法”。此外,还分析了信息控制权和信息索取权的特征,并讨论了信息权利对进一步研究企业制度安排的意义。

| Abstract: | On the basis of the right dichotomy in GHM theory,it is thought that right derives from information essentially.The conditions,in which right takes effect,the action scope of right is equal to t he capacity of right,were defined.The right corpora divided into three parts: contract right,information right and common field,that is trichotomy.The characters of information control right and information claim right were analyzed.It is pointed out that information right is significant to further research of firm institution arrangement also. |
