和谐社会视野下改革完善不起诉制度的思考

和谐社会要求在刑事诉讼中以最少的司法资源投入取得惩罚犯罪和保障人权、促进社会和谐的最大利益。不起诉制度为公正审判从程序上提供了一种筛选和过滤的制度保障,有利于促进社会和谐。不起诉制度有利于实现预防犯罪、保卫社会的目的,还有利于提高诉讼效率、体现诉讼效益。目前,不起诉制度在司法实践中的作用没有完全发挥出来,基层检察机关在执行不起诉制度时与立法原意相悖的情况还很多,有必要对不起诉制度进行改革完善。改革完善不起诉制度的措施有：证据不足不起诉的细化;酌定不起诉的扩充;不起诉的规制与救济;建立暂缓起诉制度;建立健全检察机关经费保障机制。

On the Reforming and Perfecting of Non-prosecution System from the Perspective of Harmonious Society

A harmonious society requires to obtain the judicial punishment of offenders and the protection of human rights and promote the best interests of social harmony with the least investment of resources in criminal proceedings.Non-prosecution system provides a screening and filtering system security for fair trials from the procedure,and help to promote social harmony.Non-prosecution system is conducive to crime prevention,to defend the community at large,and also to help to improve the efficiency and to reflect the effectiveness of proceedings.At present,the role of non-prosecution system in the judicial practices does not give full play,and that problem the root-grass prosecutors implement the system deviating from the legislative intent still happens usually,so it is necessary to reform and perfect the system.The measures of reforming and perfecting the system are:(a)The refinement of insufficient evidence non-prosecution(;b) The expansion of non-prosecution discretion(;c)The regulation and remedy for non-prosecution;(d)The establishment of the suspension of prosecution system;(e)To establish a sound mechanism to ensure the funding of the prosecution.
