浅谈对捕后变更强制措施的法律完善和监督

近几年来,侦查机关对犯罪嫌疑人变更逮捕强制措施的比例越来越大,且在变更过程中存在诸多问题,这些问题在一定程度上制约着这一措施的正确执行,从而影响了刑事诉讼活动的正常进行。造成这种情况的根本原因,是相关立法还存在缺陷。因此,应进一步完善相关立法,并采取可行措施,保证检察机关的法律监督有效进行。

On the Legal Perfection and Supervision of the Change of Enforcement Measure after Arrest

Recently, there are more and more cases that censorate suspect alter enforcement measure of arresting suspects, which give rise to many kinds of problems. These problems restrict the proper implement of the enforcement measure at some extend, so that criminal action is influenced. In this article, some view points on the problems aroused by the change of enforcement measure of arresting and the way to reinforce supervision and perfect legislation are proposed.
