On the Judicial Discretion in a Society Ruled by Law

Some scholars believe that there is conflict between a society ruled by law and judicial discretion and denies the existence of judicial discretion in the name of the doctrine of strict rule of law. The article elaborates on the inevitability and necessity of the existence of judicial discretion in the society ruled by law, and explores the ways of exercising judicial discretion within the most reasonable scope and by the most equitable means so that its arbitrariness can be controlled for better service of a wholesome legal system and the perfection of a society ruled by law under the precondition of maintaining the authority of the legal system.
