| 摘 要： | 在对中国法制发展的研究中,首先必须关注的是中国法制现代化中的三个重要时期:旧中国租界首先出现现代法制;自20世纪初始,中国政府通过法制改革来推进华界的法制现代化;近30年来,中国法制现代化在改革创新中逐步走向完善。这三个时期体现了中国法制现代化的起点、发展和臻于完善的三个阶段。现代法制在构建和谐社会中有着重要的作用,具体表现为:可以规范人的行为,实现社会和谐;可以调控人的行为,促进社会和谐;可以惩治犯罪,维护社会和谐等。目前,在推进法制现代化中也遇到一些困难,十分不利于现代法制建设;克服途径在于不断营造法制环境,大力提倡现代法制文化,充分发挥地方立法的作用等。
