摘    要:肯定性行动自从其诞生之日起 ,就受到不断的攻击 ,肯定性行动确实有悖于美国社会公平竞争、机会平等原则 ,但也确实给以黑人为代表的少数族裔带来了好处。进入 2 1世纪后 ,肯定性行动是否还有存在必要的问题 ,再次摆在了美国人的面前。

The Affirmative Action and the Education of American Ethnic Minorities
Abstract:Since the Bakke decision, the 1978 landmark ruling that allows race to be used as “plus factor” in public and private college admissions, the conservative and other opponents of the affirmative action argue that policy based on race or ethnic statues is unconstitutional, oppose race-based preferences in college admissions. At the same time, the minority wants to continue racial preferences, as there is the huge academic achievement gap between white and minority students. It is a fact that the affirmative action violates the principle of equal opportunity in the states; the battle over affirmative action has existed since it's beginning. The Michigan affirmative action case of 2003 makes the program under dispute again.
