略论苏联法对我国法学的影响

新中国成立以后 ,在法制建设的理论与实践方面 ,我国全盘学习苏联 ,接受了苏联的以苏维埃法概念为核心的法学理论 ,用以指导本国的法制实践 ;在宪法制度、国家机构组成、立法和司法体制及一系列立法等方面也都吸收借鉴了苏联的经验 ,并且按照苏联法学教育的模式培养了大批法学教育和司法实务人才。这一法律移植过程对我国的法制建设产生了巨大影响。在中国面向全球开放的历史条件下 ,回顾总结这一历史对我国的法制现代化事业具有十分重要的意义

On the Influence of Soviet Law on the Law in Our Country

After the establishment of P.R. China, the country learned from the Soviet Union thoroughly in the field of theory and practice of legal construction and acquired the legal theory which treated the concept of Soviet law as the core in order to instruct the domestic practice of legal system. China also absorbed and referred to the experience of the constitutional system, the composition of national institutions, the system of legislation and jurisdiction and legislation from the Soviet Union, and turned out a great many talents of legal education and practice in accordance with the legal educational model in the Soviet Union. This legal transplantation has dramatic influence on our legal construction. Under the historical condition that China is opening to the world, the retrospection of this period has great significance in our legal modernization.
