科技成果转化中的知识产权立法保护

以知识创新为成长基础的高新科技及其产业化的发展,要求科技成果不断实现转化,要求知识产权激励机制成为发展的保障.为此,需要检视我国知识产权法律制度之不足,对职务发明成果原始权利人的归属、专利申请人的资格、科技转化收益、受奖励权、技术入股等问题,对自主知识产权以及商业秘密的保护,作出立法完善.

Legislation of Intellectual Property in the Translation of Technological Production

The industrialization of hi-tech based on the knowledge innovation requires the translation of research results into practical productive forces and the incentive mechanism of intellectual property.This paper argues that some new legislation items should be enforced,such as protecting intellectual property rights and trade secrets, investing technology as capital stock, and protecting the income of technology translation.
