推进生态文明建设的法治思维和法治方式研究

党的十八大报告将生态文明建设和法治建设置于同等重要地位。法治是成熟定型的制度形式,法治的规范性、民主性、稳定性、可预期性和权威性,使其在推进生态文明建设中具有突出地位和作用。中国生态文明的法治建设已经取得很大成绩,但仍然存在不少问题。必须着力运用法治思维和法治方式推进生态文明建设,加强科学立法、严格执法、公正司法和全民守法,坚持依法治国、依法执政、依法行政共同推进,坚持法治国家、法治政府、法治社会一体建设,努力依法将生态文明建设推向一个新的发展阶段。

Study on the Legal Thinking and Legal Method of Promoting Ecological Progress

Report to the Eighteenth National Congress of Chinese Communist Party puts the promotion of ecological progress and the rule of law in the same important position. The rule of law is the mature form system and its normalization, democracy, stability, anticipation and authority make it play a prominent role in promoting the ecological progress. The legal construction of ecological progress in China has made great achievement. However, there still exist a lot of problems. We must be guided by law in both thinking and action in the effort to promote ecological progress. We should make laws in a scientific way, enforce them strictly, administer justice impartially, and ensure that everyone abides by the law. We must make sure the joint improvements of the law-based governance of the country, law-based administration and law-based action. We must make sure the integrated construction of legal country, legal government and legal society and try to promote ecological progress to further development.
