| 摘 要： | 危害环境行为入罪化已成各国刑事政策之潮流,立法实践不断加强.在对国内外立法模式及危害环境行为和环境法益进行考量的基础上,探讨了危害环境行为入罪化的前提、构成要件和谦抑,研究了实施中应注意环境刑罚权的合理配置与环境刑事处置的拓展.
