和谐社会视野下的中国动物福利立法研究

用法律制度来推动对动物福利的尊重和保障是为实现人与动物双生共赢、协调发展不可或缺的手段，亦是国际社会维护人与自然和谐的方式之一。面对当前我国动物福利法的缺失，在借鉴西方动物福利立法的具体实践和关照我国现实国情的基础上，我国动物福利法律具体制度设计的前提，是应先明确动物福利法“和谐”与“宽容”的立法价值取向，“利用与消费正义”和“保护与管理相结合”的立法原则。并在和谐社会理念的指引下，有利于人与动物的协调发展的人立法目的与模式的选择之基础上，具体区分农场动物、实验动物、工作动物、伴侣动物和娱乐动物五类动物的各自必需的、主要的福利制度。

On the Legislation of Chinese Animal Welfare in a Harmonious Society

To promote the respect for and the protection of animal welfare under the law is a necessary means to achieve a win-win situation between man and animal and to keep the harmony between man and nature. Owing to the absence of the animal welfare law in China, with reference to the western practice in this field and our present situations, it is believed that the premise for such a law is to clarify the legislative values of ＂harmony＂ and ＂tolerance＂ as well as the basic principles of ＂the use and consumption of justice＂ and ＂the combination of conservation and management＂. Under the guidance of the concept of a harmonious society, based on the legislative purpose of mutual development between man and animal and the choice of models, we have to identify major welfare systems for five different kinds of animals.
