文本·结构·实践：中国宪法权利二重属性分析

尽管中国法学学者对宪法权利或基本权利已展开了较为丰富的学术讨论，但从既有研究模式来看，还鲜有对中国宪法权利基本属性的揭示与阐发。从中国宪法（典）文本、中国主权结构与中国宪法权利实践三个维度可以发现，中国宪法权利具有二重属性：在权利主体上，阶层与公民并存；在权利性质上，政治性与治理性并存；在权利实践方式上，政治化方式与治理性方式并存。在二重属性关系中，阶层地位优于公民地位，政治性优于治理性，政治化实施方式优于治理性实施方式。

Text·Structure·Practice:A Duality Analysis of Constitutional Rights in China

In view of the existing research models, although Chinese jurisprudent scholars have launched very extensive academic discussion on constitutional rights or fundamental rights, they rarely reveal or illustrate the fundamental attributes of constitutional rights in China. From three perspectives, namely the text of Chinese Constitution （Code）, the sovereignty structure of China and the practice of constitutional rights in China, constitutional rights in China are of duality： as to the subject of rights, the social stratum coexists with citizenship; as for the nature of constitutional rights, politics coexists with governance; in terms of the practice approach of constitutional rights, the political means coexists with governing means. In the state of duality, the social stratum is prior to citizenship, politics is prior to governance, and political implementation is prior to governing implementation.
