| 摘 要： | 法律对人的作用,不能仅仅从法律规范的自身来理解,法律给予主体的权利是给予行为主体实施某种行为的可能性,这种可能性能否得到主体的实施就看主体是否有实施法律行为的动机,而这种动机又是由人的需要来决定的,只有通过人的需要与动机的实际考察才能发现法律的实际运行过程,并由此得出法律的评价标准.

| Abstract: | The functions of laws to man can't be comp relendeel from the law standarization itself.The right of the corpus gicen by laws is a certain behavioal possibiloty to give the behavior corpus.The fulfillment of this possibility depends on the mofive of the corpus to perform law behaviors,while the motive is determiaed by the human needs,only by whichy humar needs and motive can leed to discover the practical working proces,thus we can reach the evalating level of laws. |
