数字化作品合理规避权探讨

为技术措施版权保护设定属于使用者的合理规避权，体现了著作权法维护权利人利益和社会公共利益的平衡精神。合理规避权的法律基础在于技术措施保护会妨碍传统环境下公众基于合理使用所享有的利益，若保护过度，也会成为侵害使用者权益的工具。美国的立法和司法实践已经建构起较为体系化的合理规避权条款。为保护社会公众和使用者的利益，我国应进一步完善合理规避权的制度设计。

On Digital Works Reasonably Avoid Right

The statutory distinction between access controls and rights protection that was adopted to fa- cilitate fair use should be carefully maintained. Only conduct that actually threatens interests protected by the circumvention and trafficking bans should be actionable. Access controls not only prevent end-users from enjoy- ing copyrighted works, but also block potential authors from utilizing works in the creation of new works in ways that were formerly allowed.
