中国不动产登记制度的立法思考

我国目前的不动产登记制度存在诸多缺陷,在未来制定的中国物权法中,不动产登记制度无疑是其中的重点内容。文章首先阐述了不动产登记的概念、性质和意义,然后运用比较法学的研究方法,介绍了现在世界上三种典型的不动产登记制度,并主要从价值判断和利益分析的角度,结合我国的具体国情,提出我国未来的不动产登记应采对抗主义、形式审查制。在具体制度的设计中,要注意坚持“五个统一”的原则。 

Research on the system of Estate Register in China

There are some limitations in the system of estate register in China. It is sure that the system of estate register is an important part in the intending law of real right. At first,this paper sets forth the concept, character and purport of estate register, then presents three typical systems of estate register of the world in the way of comparative jurisprudence. finally, the author draws the conclusion that China ought to take ism of counterwork and the system of formalist censor, and must insist on the principle of "five unifications" in the design of idiographic systems.
