| 摘 要： | 证人出庭作证问题关系到庭审方式改革成功与否.本文探讨了证人拒不出庭作证的弊端,从立法的、制度的、文化的角度进行了原因分析,并参考借鉴国外相关立法,对我国刑事证人出庭制度的确立提出建议.

| Abstract: | The issue of witness' rejection to appear in court for criminal suit, to a certain degree, decides the success in the reform of trial method. Therefore, this paper attempts to inquire into the disadvantages of witness' rejection to appear in court for testimony and analyses the reasons from the perspectives of culture, legislation and legal institution. Moreover, with reference to the corresponding legislations in some other countries, proposals are offered on the establishment of the system of witness' appearance in court for testimony. |
