再论我国法社会学研究的结构性缺陷——从方法的角度

我国法社会学结构性缺陷的客观存在,在一定程度上阻碍着我国法社会学的进一步发展。从方法论角度研究我国法社会学结构性缺陷,可以看到该缺陷对我国法社会学研究产生了巨大的影响:研究方法单一及其由此而带来的研究视野的狭窄和本土法律实践研究难以深入。因此,引入社会学研究方法及其研究成果,增加我国法社会学的社会学性,是改变我国法社会学结构性缺陷的必由之路。

Elaborate Structural Flaws in Chinese Sociology of Law: A Methodological Perspective

The structural flaws that exist in Chinese sociology of law have to some extent hindered the further development of this discipline. From the perspective of methodology,such flaws exert an immense influence, such as a unitary research method,a narrow vision of research and the difficulty in deeply undertaking practice research of local laws.Therefore,it is the only choice for the structural transformation of Chinese sociology of law to introduce sociological research methods and its research outcomes, and to emphasize the sociological nature of Chinese sociology of law.
