试论排污权交易法律制度的构建

排污权的实质是环境容量资源使用权，其客体是环境容量资源。排污权交易法律制度是将市场机制引入环境资源配置和污染控制领域的重要手段。目前，我国推行排污权交易法律制度存在很多问题，现有法律缺乏相关规定；初始分配制度不完善；市场制度不健全；监测监管制度不全面；与相关制度的关系不清晰。我国应构建完备的排污交易法律法规体系、完善的排污权初始分配制度、健全的排污权交易市场制度、全面的排污权交易监测监管制度以及衔接关系清晰的排污权交易制度，逐步形成适合中国国情的排污权交易法律制度。
