浅析医疗事故的责任承担

医疗事故是指在诊疗护理过程中,因医务人员诊疗护理过失,直接造成病员死亡、残废、组织器官损伤,从而导致其出现功能障碍的情形或其他不良后果。根据我国法律和相关规定,医疗事故责任包括民事、行政和刑事三部分责任,在实际的承担中可以概括为"双罚制",即对发生医疗事故的单位追究其民事责任,对直接责任人员追究行政责任、刑事责任。

According to concerning law regulation and theory of our country, the malpractice duty chiefly includes relating to civil law and three parts administration and criminal responsibility, namely practical undertaking can conclude two systems punishing,looks into his responsibility relating to civil law duty to the unit occurring the malpractice, and looks into administration duty and criminal responsibility to direct duty personnel.
