| 摘 要： | 遗失物归属制度用于规范拾得人与失主之间的权利义务关系。《物权法》通过外在的法律强制限制了拾得人取得所有权,实现了道德上的理想,然而立法者未意识到,任何道德只能建立在自由意志的基础上。在中国现阶段,在对待遗失物的态度上,不能提出过高的道德要求,相关制度设计有待完善。
