论和谐社会与仲裁制度

和谐社会的基础是社会稳定。和谐社会也有纠纷,只是是一个纠纷解决机制健全有效的社会。社会生活方式的多样性、人们观念的差异和对利益追求的价值不一致导致社会纠纷的多样性,决定解决社会纠纷的途径应当多元化。仲裁作为纠纷解决的重要途径,在中国有社会基础,与民间长期存在的调解习惯、＂无讼＂理念相符。仲裁具有促进社会和谐的内在要素。意思自治是仲裁的基础,体现了对当事人的尊重;一裁终局、耗时较少、费用低廉显示了仲裁效率,是仲裁的优势,优化了社会资源的配置;专家仲裁、中立公正有利于当事人的认可,是仲裁的灵魂。
