| 摘 要： | 反垄断法对于保护国家经济安全、维护市场公平和自由竞争具有重要作用。反垄断法的域外管辖权是针对国外发生,但对国内市场产生限制、排除竞争影响的垄断行为适用国内法加以规范的权利。从反垄断法域外管辖权的法理基础——国家主权原则出发,剖析美国、欧盟等实现域外管辖权的典型立法例和针对域外管辖的＂阻拦立法＂的典型立法例,对中国反垄断法域外管辖权的存在和运行机制进行分析,并结合中国的实际情况,提出完善、保障和最终实现中国反垄断法域外管辖权的建议。
