| 摘 要： | 特征性履行方法产生于欧洲,是一种欧洲国际私法理论。特征性履行理论同最密切联系原则有着不可分割的联系,是将最密切联系原则适当具体化、固定化、可操作化的重要方法。在我国涉外民商事审判中,经常利用特征性履行方法来确定最密切联系地。

| Abstract: | Characteristic performance method produced in Europe,is a European international private law theory.The theory of characteristic performance has an inseparable relation with the most significant connection,which is an important method that makes the Most Significant Relationship appropriately be specific,fixed,and operationability.In foreign civil and commercial trial in China,characteristic performance is often used to determine the most significant connection. |
