| 摘 要： | 反垄断法是规制市场相关垄断行为,以达到规范市场秩序,维护市场正常运行的"经济宪法"。它在经济法中有着至关重要的作用,而适用除外制度在反垄断法中也有着不可替代的作用。适用除外制度可以协调反垄断法本身价值与相关国家政策的冲突,使相关国家政策在反垄断法中得到实现。本文探讨适用除外制度的含义,说明适用除外制度存在于反垄断法中的原因,分析适用除外的适用范围,并提出我国反垄断法适用除外制度完善的建议。

| Abstract: | Anti-monopoly law is an ＂economic constitution＂ related to regulation of market behavior in order to regulate market order and maintain the normal operation of the market.It has a vital role in the economic law,and exception system has an irreplaceable role in anti-monopoly law.Exception system can coordinate the conflict between antimonopoly law＇s value and the related national policies to make related national policies realize in anti-monopoly law.This paper discusses the meaning of exception system,explains the reasons of exemption system existing in anti-monopoly law,analyzes the range of application of exception system and puts forward the suggestions of perfecting our country＇s antimonopoly law exception system. |
