| 摘 要： | 国家法由民间法发展而来,由于国家的加入,民间法和国家法出现了分野,同时产生了冲突、互动和融合。国家法与民间法的关系不是单向的,二者是互动存在的。国家法借民间法而落其根,坐其实;民间法借国家法而显其华、壮其声。但两者在现实司法实践中很多时候出现冲突,本文就该问题进行了分析,并提出了促使民间法与国家法相协调的途径。

| Abstract: | The state law evolved from the civil law,but the country's accession,civil law and state law have a distinct scope,but in the meanwhile there are conflict,interaction and integration.The article analyzes the relationship between them and puts forward the ways to promote the civil law and state law to be in a coordinated way. |
