环境公益诉讼法律制度研究——以环境民事公益诉讼为中心

我国环境民事公益诉讼制度在法律上的空白以及现行法律在环境公益保护方面存在的问题,表明我们必须尽快在借鉴国外立法经验的基础上,从现实和法理的角度出发,构建合理的立法模式、起诉模式、诉讼当事人资格、事前与事后诉讼相结合、诉讼费用、诉讼时效等制度,建立起具有中国特色的环境民事公益诉讼法律制度。

A Study of Legal System of Environmental Public Benefits Lawsuit

The increasing severity of environmental problems needs legislation for safeguarding and effective enforcement.The environmental civil lawsuits are an important channel through which to protect environmental pubic benefits,and turn environmental rights from theory to practice.However,there exists a blank of law in the current civil lawsuit regulation of the environmental public benefits,and some problems in the environmental public benefit protection in the current law system.On the premise of adopting the practice of legalization abroad,this paper starts with the perspectives of the reality and principles of law and puts forward the plan to establish the civil lawsuit system of environmental public benefits with Chinese features.
