| 摘 要： | 专利制度是国际上普遍采用、行之有效的促进科技进步和经济发展的一项重要法律制度，充分体现了市场经济有关价值、竞争、产权约束的原则．专利权是权利主体和价值主体的统一体，其基本作用是通过法律规范，引导和制约市场经济的健康发展．实行专利制度的根本目的是保护和鼓励技术领域内的公平竞争，使发明创造尽快转化为现实的生产力，使专利技术产品进入流通市场。
