| 摘 要： | 字号、商号与商业名称之间,到底是一种什么样的关系,商事立法与理论上均有不同的看法与见解,且直接影响到相关的企业名称纠纷案的处理结果。通过对各种看法进行分析,提出商业名称是指商事主体在从事商行为时所使用的完整名称,字号与商号涵义等同,均是商业名称的结构性组成部分的观点,并提出相应的立法建议。

| Abstract: | There are different understandings and opinions about the relation among firm name,trade name and commercial name in commercial affairs legislation and theory, which directly influences the solution of concerning enterprise name disputes.In this paper,based on analysis of different opinions,it is held that commercial name is complete name used by merchants who undertake their business.Meanings of firm name and trade name are the same,both are structural components of commercial name.Accordingly the concerning legislation is proposed. |
