| 摘 要： | 运用社会公平和法正义原则评述政治权利和义务之关系命题不仅关涉社会学、政治学和法哲学的基本命题,而且关涉社会学、政治学和法哲学的基本方法问题。这种基本方法最初对人的自然道德状况进行审视,进而审视人在进入政治社会后,作为政治共同体的成员所享有的基本权利和义务,以及他们之间的特殊作用。评析的前设条件:(1)所有的人不论其出生于何时何地,他们的政治生活都源于在政治社会中所享有权利和履行义务的实体性主体身份;(2)正在讨论中的权利不仅包括一般性政治权利,而且包括广泛的自治权利和独立权利。并在此前提下批判地评述了西方具有争论性的公平原则以及在公平原则项下的政治权利和义务实现的前提。
