| 摘 要： | 我国经济转型中出现的市场失效引起了市场秩序的混乱,提高市场调节效果,维护市场秩序的重要途径是建立市场规范,也就是建立市场规则。不同的理论范式对市场规则有不同的要求,竞争范式要求市场规则以竞争为中心,制度范式要求通过制度安排对竞争行为进行规范和约束,保证契约的执行,同时降低市场交易的成本。

| Abstract: | In the course of the economic transition in China, market failing has caused market disorders. The most important way is to establish a market rule. Different theory paradigms need different market rules. The theory of Competition paradigm demands competition as a role. The theory of institutional paradigm needs to restrain and standardize the competition action, to guarantee the contract, as well to lower the market exchange cost. |
