网络环境下的技术保护措施在给著作权人充分保护的同时,限制了公众的合理使用和对作品公共部分的接触,著作权原有的利益平衡被打破。恢复著作权的利益平衡,关键在于＂合理使用＂能否成为规避技术保护措施的理由这一问题的解决,其也是技术保护措施与＂合理使用＂能否协调的关键。文章采用比较分析法、案例分析法,从＂合理使用＂作为著作权法利益平衡机制的角度出发,分析了上述问题,认为＂合理使用＂应当为规避技术保护措施的法律理由,并以＂合理使用＂为核心提出对技术保护措施限制的建议。
