| 摘 要： | 对电子商务商业方法的专利保护进行了阐述,指出对电子商务商业方法的专利保护不仅可以促进该种商业方法的创新,也能为电子商务的经营提供制度保障。美国、日本已通过立法对电子商务商业方法进行专利保护,并在我国申请该种专利。认为我国在加强电子商务领域创新的同时,还应确立符合我国国情的电子商务商业方法的专利保护制度,以适应国际竞争的需要。

| Abstract: | The patent protection of e-commerce business method can not only promote the innovation of business methods,but also can provide e-business system protection.The United States and Japan had passed legislation on e-commerce business method patent protection,and submitted patent applications in China.China should strengthen e-commerce innovation and establish patent protection system of e-commerce business method to meet international competition. |
