民事执行检察监督方式

检察院对法院民事执行行为具有不同的检察监督方式,不同地方采用了不同做法,抗诉、检察建议、纠正违法通知书等方式的运用略显冗杂,缺乏统一标准。刚刚公布的《民事诉讼法修正案(草案)》虽然从立法层面对检察监督方式进行了相应的厘清,但修缮范围有限,并不能完全解决今后民事执行检察监督方式适用杂乱的问题。域外其他国家和地区的立法具有相对明晰的检察监督方式体系,值得我国借鉴、整改。

Inspection and Supervision Methods of Civilian Implementation

Execution behavior of the civil court’s Procuratorate have different inspection and supervision methods,using different approaches in different places,the application of methods such as protest,procuratorial suggestions and notice to rectify illegal act seem to be slightly jumbled and lack of uniform standards.Although The Code of Civil Procedure Amendment(Draft) just released clarified the ways of inspection and supervision from the legislative level,its amendment scope is limited and cannot solve the problems of disordered application of the ways of inspection and supervision of civilian implementation.Extraterritorial legislation in other countries has relatively clear system of inspection and supervision methods,which is worth of our learning and rectification.
