试论对弱势群体的法律保护

“弱势群体”是对在政治、经济、文化以及生理健康等方面处于弱势地位的人群的总称,其缺乏组织资源、经济资源和文化资源的占有能力。弱势群体的成因既有先天因素,亦有后天社会因素。现有法律不足以保护其利益,故需探求新的保护机制和方式。在法律理念更新的基础上,采取多方位、多层次的保护措施,完善保护弱势群体的法律体系,方能实现社会的实质公平。

On Legal Protection to the Weak Group

The weak group is the generic name of the people who are in the weak position in the aspects of politics,economy,culture and physiological health,who are lack of the ability of possessing organizational,economical and cultural resources.The reason for the formation of the weak group is composed of both born aspects and acquired elements.Present laws are not enough to protect such people's benefits,so it is needed to quest new protection mechanism and methods.Based on the updating of legal conceptions,only by taking multilevel protective measures and perfecting the legal system of protecting these people can the fairness of the society be realized.
