| 摘 要： | 作为独立的法学学科,卫生法学应形成公认的理论体系。目前,学界对卫生法学理论体系问题缺乏深入研究。在分析现有研究中存在的问题的基础上,提出卫生法理论体系的研究中应处理好的若干关系和应注意的问题,并进一步认为卫生法学的理论体系应由基础理论、卫生主体法、卫生监督管理法和医患关系法构成。

| Abstract: | As a separate science of law,health jurisprudence should have its own theoretical system.So far,no detailed study has been made on this theoretical system.With an analysis of some problems in this respect,the author presents several questions that should taken into consideration in the research of the theoretical system of health jurisprudence,and puts forward the view that this system should be composed of basic theories,law of health main body,law of health supervision and administration,and law of relation. |
